Trump may well withstand impeachment if 17 GOP senators fail to act but impeachment has no penalty clause and the Senate may choose to ban Trump from holding further office.

Totally independent of this is the criminal justice system where Trump may now be tried for crimes committed during his presidency.  Without Barr to try to defend him, as in the past through wildly misinterpreting legal precedents, Trump now faces a criminal investigation that can culminate in an arrest and trial.

Daily Beast: Donald Trump decided not to pardon himself in his last-gasp spree of clemencies in the dying hours of his presidency on Wednesday—and, if House Speaker Nancy Pelosi is right, that’s a decision he may come to regret.

In an interview with MSNBC’s Joy Reid that ran Tuesday night, Pelosi said that she believes the president’s role in the deadly Capitol riot this month makes him an accessory to the crime of murder. She told Reid: “Presidents’ words are important. They weigh a ton… [The rioters] used his words to come here.”

Pelosi then went a step further and said Trump’s incitement of the violence makes him an accessory to the crimes committed during the riot. She said: “The crime, in some cases, was murder… And this president is an accessory to that crime because he instigated that insurrection that caused those deaths and this destruction.” and from Politico:

The speaker went a step further and said that if it were proven that some members of Congress collaborated with members of the group that attacked the Capitol, they — as well as Trump — would be accessories to crimes committed during the insurrection.

“And the crime, in some cases, was murder,” Pelosi said. “And this president is an accessory to that crime because he instigated that insurrection that caused those deaths and this destruction.”

‘I do think that we’re bigger than all of this. Donald Trump was a stain on our country. I don’t think we could have sustained our democracy if he had two terms in office, for what he was doing to our institution or what he was doing to our Constitution. He dishonored it,’ she told MSNBC.
